Employers’ liability and duty of care

Employers are obligated to maintain a minimum standard in the workspace and work environment of their employees. According to our law, the employer is obliged to maintain the work premises, tools and implements in such a way that the employee is not in danger or risks suffering damages during work. This duty of care entails that the employer under certain circumstances must provide safety instructions and must ensure that the employees actually follow these instructions. If the employer does not adhere to his of her duty of care, then he or she can be liable for damages as a result of any shortcomings which may have been the cause of the incident. It is therefore important for employers to be well informed regarding such standards to avoid unnecessary liabilities.
